…By Dorcas Funmi for TDPel Media. The Presidential Election Petition Court (PEPC) in Abuja has decided to postpone further proceedings concerning the Allied Peoples Movement (APM)’s challenge to the 2023 presidential election results.
The court has rescheduled the hearing for Friday, temporarily halting the APM’s case.
Supreme Court Decision Raises Concerns in Tinubu’s Representation
During Tuesday’s hearing, President Asiwaju Bola Tinubu’s legal representation raised concerns based on a recent Supreme Court decision.
This prompted the court to pause the APM’s case, which questions Tinubu’s presidential election victory.
Tinubu’s lawyer, Chief Wole Olanipekun, argued that the APM’s claim regarding Vice President Kashim Shettima’s nomination had already been addressed by the Supreme Court in a recent ruling.
APM Requests Adjournment to Review Supreme Court Decision
Mr S.A.T. Abubakar, the APM’s counsel, requested an adjournment to review the Supreme Court decision presented by Tinubu’s legal team.
Legal representation for the Independent National Electoral Commission (INEC) and the All Progressives Congress (APC) did not oppose the postponement request.
Proceedings Postponed, Pending Single Witness Presentation
Following the request for adjournment, the panel led by Justice Haruna Tsammani agreed to postpone the proceedings until Friday.
The APM’s petition claims that the withdrawal of Mr Ibrahim Masari, the original Vice-Presidential candidate for the APC, rendered Tinubu’s candidacy invalid under relevant sections of the 1999 Constitution.
In the meantime, the court has granted permission for the APM to present its proposed single witness.
President Tinubu and APC Challenge Validity of APM’s Petition
President Tinubu and the APC have filed motions contesting the validity of the APM’s petition.
They argue that the petition lacks merit, and these motions are yet to be resolved by the court.
