Lawyer Reacts as Court Orders Peter Nwachukwu to Enter Defence in Homicide and

Court’s Decision on Peter Nwachukwu’s ‘No Case Submission’

The legal representative of Peter Nwachukwu, the husband of the late gospel singer Osinachi, Isah Abubakar Aliyu, has responded following a recent court ruling.

A high court situated in the Federal Capital Territory, Wuse Zone 2, Abuja, has dismissed Nwachukwu’s ‘no case submission’ application in a homicide and domestic violence-related suit.

This suit was initiated by the Office of the Attorney-General of the Federation on June 3, 2022.

Background of the Case

The case stems from the unfortunate passing of Nwachukwu’s wife on April 8, 2022.

Allegations arose from many of her colleagues in the music industry, suggesting that she had been mistreated by her husband prior to her tragic death.

Following these allegations, Nwachukwu was arrested by the police, and he was subsequently arraigned on a 23-count charge that encompassed domestic violence and homicide, among other charges. In response, he pleaded not guilty to these charges.

The No-Case Submission

In an attempt to have the charges against his client dismissed, Peter Nwachukwu’s lawyer, Aliyu, had filed a ‘no case submission.’

This legal maneuver essentially argued that Nwachukwu had no case to answer concerning the charges brought against him.

Court’s Ruling and Next Steps

However, in a recent ruling, Justice Njideka K. Nwosu-Iheme found that the prosecution had successfully established its case against Peter Nwachukwu.

As a result, the court ordered that Nwachukwu should enter his defence in the case.

The court set the next adjourned date for November 22, indicating the commencement of the defence phase.

Legal Perspective on the Court’s Decision

After the court session concluded, Peter Nwachukwu’s lawyer, Aliyu, addressed the media.

He conveyed that his client was prepared to enter his defence, acknowledging the court’s ruling.

Aliyu explained, “It (the court) has delivered its ruling, and we are left with the option of entering our defence.

I’m sure by the next adjourned date, we will do justice to that.”

He emphasized that the court had instructed Peter to enter his defence, and they would adhere to this directive.
