…By Dorcas Funmi for TDPel Media. The Lamidi Apapa-led faction of the Labour Party (LP) National Working Committee (NWC) maintains its stance on the suspension of National Chairman Julius Abure, dismissing the recent ruling by the Edo State High Court.
Court Ruling Dismissed
Justice Emmanuel Aihamoje of the Edo High Court declared the case against Julius Abure as lacking merit and threw it out.
The judge ruled that the party ward executive did not possess the authority, according to the LP constitution and the Electoral Act, to remove the national chairman.
Faction Stands Firm
Dr. Abayomi Arabambi, the National Publicity Secretary of the Apapa faction, addressed journalists in Abuja, stating that they do not accept the claim that the Edo State High Court had reinstated Julius Abure as National Chairman.
Arabambi described the response to the ruling as a “beer parlour response” containing deliberate falsehoods.
Impact of the Ruling
Arabambi explained that the judgment merely nullified the suspension of Abure as a member of the party at the ward level.
However, Abure is still restrained from acting as a national officer due to the restraining order from the FCT High Court.
Additionally, the National Executive Committee (NEC) of the party suspended Abure and other members for attending an unauthorized NEC meeting.
Appeal and Court Jurisdiction
Arabambi highlighted that an appeal had been filed against the FCT High Court’s decision regarding the suspension and restraining order on Abure.
He argued that while an appeal is pending, no lower court can adjudicate on the matter.
Therefore, the Edo State High Court’s judgment is deemed futile and void.
Warning to Legal Practitioner
The Labour Party cautioned Mr. Allex Ijetieme, the lawyer involved, to exercise caution and refrain from spreading deliberate falsehoods against the judiciary.
They hinted at the possibility of petitioning the Legal Practitioner Disciplinary Committee of the NBA if necessary.
