…By Larry John for TDPel Media. The Court of Appeal in Abuja has ruled that Chief Ambrose Albert Owuru, a former presidential candidate, must pay a fine of N40 million Naira for attempting to halt the inauguration of President-elect Bola Tinubu, scheduled for May 29, 2023.
This fine includes N10 million each to be paid to President Muhammadu Buhari, the Attorney General of the Federation (AGF) Abubakar Malami, the Independent National Electoral Commission (INEC), and President-elect Tinubu, who were named as the 1st to 4th defendants in the case.
Abuse of Court Process and Frivolous Lawsuit
The three-member panel of the court found Chief Ambrose Albert Owuru guilty of gross abuse of the court process for filing a frivolous, vexatious, and irritating lawsuit with the intention of provoking the respondents.
Led by Justice Jamil Tukur, the panel concluded that Owuru’s grievances regarding the 2019 presidential election were not only strange but also unwarranted since those grievances had already been pursued and dismissed by the Supreme Court for lack of merit.
Resurrecting a Case and Challenging the Supremacy of the Apex Court
Justice Tukur stated that Owuru’s decision to revive a case that had been settled in 2019 by the Supreme Court was an attempt to create a conflict between the lower courts and the authority of the apex court.
By doing so, Owuru aimed to undermine the supremacy of the highest court in the land and disrupt the smooth functioning of the judicial system.
In summary, the Court of Appeal in Abuja has ordered Chief Ambrose Albert Owuru, a former presidential candidate, to pay a fine of N40 million Naira for his abuse of the court process and the filing of a frivolous lawsuit.
The court emphasized that Owuru’s attempt to resurrect a case that had been dismissed by the Supreme Court in 2019 was an effort to challenge the authority of the highest court and disrupt the judicial system.
