The tribunal’s judgment, issued in September, ordered the Independent National Electoral Commission (INEC) to conduct a supplementary election within 90 days in 33 specific polling units.

Additionally, INEC was instructed to withdraw the return certificate previously issued to Thaddeus Attah and arrange new elections in areas where the initial election had not been conducted on February 25.

In contrast to the tribunal’s directive, the Appeal Court, in its recent ruling, overturned the earlier decision and declared that the elections in Eti Osa Federal Constituency were indeed conclusive.

This outcome supersedes the prior declaration of Bankole Wellington, famously known as Banky W, who was the candidate of the Peoples Democratic Party (PDP) and had been recognized as the runner-up in the February 2023 election.

It also affects the candidacy of Ibrahim Babajide Obanikoro, who represented the All Progressives Congress (APC) in the same election.
